01Accepting these terms

These Terms & Conditions ("Terms") are an agreement between you and SPDJ Media Pvt Ltd ("we", "us"), the publisher of the NeXGen GPT app ("the app") and this website. By downloading, installing or using the app, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the app.

02Who can use the app

You must be at least 13 years old to use NeXGen GPT. If you are under the age of majority where you live, you may use the app only with the involvement of a parent or guardian who agrees to these Terms. Purchases must be made by, or with the permission of, the Google Play account holder.

03The service

NeXGen GPT is an AI assistant that lets you chat, write, summarize documents, ask about photos, translate, solve problems, use specialist assistants and create or edit images. The AI features are powered by Google Gemini models provided through Firebase AI Logic.

The app needs an internet connection for AI features. We work to keep it fast and available but don't guarantee that it will be uninterrupted or error-free. We may add, change or remove features, models, daily limits or Create tools at any time.

04AI-generated content

Answers, documents and images produced by the app ("Output") are generated automatically by AI models. Because of how these models work:

• Output may be inaccurate, incomplete, outdated, biased or offensive, and may look confident even when it is wrong.
• Output is not professional advice. Don't rely on it for medical, legal, financial, safety or other important decisions — consult a qualified professional.
• Similar requests from different people may produce similar Output; Output isn't guaranteed to be unique.
• Images of real people, brands or styles are AI interpretations and are not endorsed by those people or owners.

You can tap Report on any answer or picture to tell us about Output that is harmful, wrong or inappropriate. We review reports to improve safety.

05Acceptable use

You agree not to use NeXGen GPT to create, request or share content, or take actions, that:

• sexualizes or exploits minors in any way;
• is illegal, or promotes violence, terrorism, self-harm, or the making of weapons or dangerous substances;
• harasses, threatens, bullies, defames or discriminates against any person or group;
• creates non-consensual intimate imagery, or deceptive content (such as deepfakes) intended to mislead or impersonate a real person;
• infringes someone else's copyright, trademark, privacy or other rights;
• involves spam, scams, fraud, phishing or malware;
• tries to bypass safety filters, daily limits, App Check or payment, or to reverse engineer, copy or resell the app or its AI access.

You also agree to follow Google's Generative AI Prohibited Use Policy, which applies to the models the app uses.

06Your content and the Output

"Your Content" means the text, photos, files and voice text you give the app. You keep any rights you have in Your Content, and you confirm that you have the right to use it. You give us and our service providers permission to process Your Content only as needed to run the app — for example, sending it to Google Gemini to generate an answer, as described in the Privacy Policy.

As between you and us, you may use the Output you generate for personal or commercial purposes, subject to these Terms, applicable law and the rights of others. You are responsible for reviewing Output before you use or share it, and for making sure your use doesn't infringe anyone's rights.

Your chats, memories, Library and images are stored on your device. We don't back them up, so deleting the app or using "Delete all my data" removes them permanently.

07NeXGen PRO, subscriptions and payments

NeXGen PRO is an optional upgrade that removes ads and lifts the daily image limit, subject to fair-use limits. It is offered as monthly or annual subscriptions and, where available, as a one-time lifetime purchase.

• Billing. All purchases are processed by Google Play and are subject to the Google Play Terms of Service. The price, billing period and renewal terms are shown in the app before you buy.
• Auto-renewal. Subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before renewal.
• Cancelling. Cancel any time in Google Play → Payments & subscriptions → Subscriptions. You keep PRO until the end of the period you've paid for.
• Free trials & offers. If a trial or introductory price is offered, its terms are shown before purchase; unless you cancel before it ends, it converts to a paid subscription.
• Refunds. Refunds are handled under Google Play's refund policies. You can request one through Google Play, or contact us and we'll help where we can.
• Price changes. If a subscription price changes, Google Play will notify you in advance as required.
• Fair use. "Unlimited" image creation is subject to reasonable fair-use limits that keep the service fast and affordable for everyone and prevent abuse.

08Advertising

The free version shows ads served by Google AdMob. Ads are shown at natural breaks and never inside notifications. Where required, the app asks for your consent before showing personalized ads; see the Privacy Policy.

09Third-party services

The app relies on services from third parties, including Google Gemini and Firebase (AI and App Check), Google Cloud Firestore (reports), Google AdMob (ads), Google Play (billing) and your phone's speech services. Their own terms and policies apply to your use of them, and we aren't responsible for their availability or practices. Links to other websites are provided for convenience only.

10Intellectual property

The app, its design, code, name, logo and content (excluding Your Content and your Output) belong to us or our licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, in line with these Terms and the Google Play Terms of Service.

NeXGen GPT is an independent product. "Google", "Gemini", "Firebase" and "Google Play" are trademarks of Google LLC, and "GPT" and "ChatGPT" are associated with OpenAI. NeXGen GPT is not affiliated with, endorsed or sponsored by Google LLC or OpenAI.

11Disclaimers

To the fullest extent permitted by law, the app and all Output are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose, merchantability and non-infringement. Nothing in these Terms limits rights you have under consumer laws that cannot be excluded.

12Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising from your use of — or inability to use — the app or any Output, including decisions you make based on Output.

Our total liability for any claim relating to the app is limited to the greater of the amount you paid for NeXGen PRO in the 12 months before the claim, or INR 1,000. You agree to indemnify us against claims arising from your misuse of the app or your breach of these Terms.

13Suspension and termination

You can stop using the app at any time by uninstalling it. Cancelling the app doesn't cancel a subscription — cancel it in Google Play. We may restrict or end access to AI features for anyone who breaks these Terms or misuses the service, or if we need to stop offering the app. Sections that by their nature should survive (such as 4, 6, 10, 11 and 12) continue to apply.

14Changes to these terms

We may update these Terms as the app evolves or the law changes. We'll post the new version here and update the effective date; for significant changes we'll also tell you in the app. Continuing to use the app after a change means you accept the updated Terms.

15Governing law

These Terms are governed by the laws of India. Courts in India will have jurisdiction over any dispute, except where the consumer laws of your country give you the right to bring a claim where you live. Before starting any formal claim, please contact us — most issues can be solved quickly by email.
